Terms of Service

Last updated: October 12, 2026

These terms are the agreement between you and DATA SWEEP S.R.L., EUID ROONRC.J2024022622006, registered office at Piața Emanuil Gojdu 41, Building I, ground floor, Oradea, Bihor County, Romania ("DATA SWEEP", "we", "us"), which builds and owns Brioly (the brioly.app website and the iOS and Android apps). By creating an account, including with Google or Apple, you confirm that you've read and accept them. If you don't agree, please don't use Brioly.

1. What Brioly is

Brioly is an exam-prep platform. You can upload study materials (PDFs, photos, text) and the AI turns them into tests, summaries, mind maps, flashcards, project plans and podcasts. You can take practice exams, study in groups and communities, use the 3D atlas and track your progress with XP, levels, daily streaks, leaderboards and My World.

Brioly is free right now. Because the platform is under active development, features may change, new ones may appear and some may be turned off. If we ever introduce paid plans, we'll announce them in advance, and nothing is ever charged without your explicit agreement.

2. Who can use Brioly

You must be at least 16. If you're between 16 and 18, we recommend letting your parents know you use Brioly; claiming a competition prize requires a parent's or guardian's consent (see the Competition Rules).

Give us accurate information when you sign up and keep it up to date. An account belongs to one person only.

3. Your account

4. Coins, XP and other rewards

Coins are used to generate tests, summaries, podcasts and other study materials. You get free coins every day, and some actions (like inviting a friend) earn you extra. Amounts and costs are shown in the app and may change.

Coins, XP, sparks, stars, Brios, levels, badges and My World shop items have no cash value and can't be exchanged for money, sold or transferred. We may correct or cancel rewards earned through bugs, abuse or a breach of these terms.

5. Founding Members

The first 1,000 people to create an account (not counting the Brioly team and technical accounts) are Founding Members: they get a numbered badge on their profile, more free coins per day during their first two months and access to Founding Member events.

The first 100 Founding Members get 12 months of the paid plan for free if and when we launch subscriptions. The perk is personal, applied to the account automatically, non-transferable and not exchangeable for cash. It's lost if you delete your account or if your account is closed for breaching these terms.

6. Your content

The materials you upload (courses, books, notes, photos, handwritten papers) stay yours or belong to whoever holds the rights to them. The tests, summaries and other study materials the AI creates from your content are yours: you can use, download, edit and share them, as long as you respect the rights in the original material.

You give us a non-exclusive, royalty-free, worldwide license, for as long as the content stays in Brioly, to store it, process it (including with AI and through the providers listed in our Privacy Policy) and show it to you and to the people you choose to share it with (a group, your school, the library). The license ends when you delete the content or your account, except for copies others have already saved legitimately (for example, a test a classmate downloaded).

We don't use your materials to train AI models, we don't sell them and we don't make them public unless you do.

If you send us suggestions, feedback or ideas, we may use them freely to improve Brioly, with no obligation to you.

7. Copyright and responsibility for content

Brioly hosts materials uploaded by its users at their request. Under Romanian Law 365/2002 on e-commerce and the EU Digital Services Act (Regulation (EU) 2022/2065), DATA SWEEP isn't liable for content uploaded or shared by users as long as it has no knowledge that the content is illegal and acts promptly to remove it once it does. We don't review what you upload in advance.

Whoever uploads or shares content is responsible for it. When you upload or share a material, you confirm you have the right to: you made it, the rights holder agreed, or the use falls under a legal exception (such as a personal copy or quoting for teaching). If you infringe someone else's rights, you're responsible to the rights holder and you'll compensate us for any claims they bring against us because of your content.

8. Content made by Brioly

Ready-made tests, practice exams, papers, marking schemes, explanations, the summaries and flashcards in communities, the 3D atlas and other content we create are protected by the rights of DATA SWEEP or our licensors. You can use them, including downloaded, for your own learning and, if you're a teacher, in class with your students. You can't sell or republish them or use them to build a competing service.

For our own content, we only use sources we're allowed to use:

Practice exams follow the format of the real ones (number of questions, time, scoring), but they aren't the official exams and aren't endorsed by the organizing bodies. Brioly isn't affiliated with any exam organizer; exam names such as IELTS, TOEFL, SAT and CFA are trademarks of their owners.

Our content contains marks that let us recognize copies, and files you download or print carry your name, the date and a download code tied to your account. If we find our content republished without permission, we can trace it to the account it came from and suspend that account, on top of any other remedies the law allows.

9. AI, estimated scores and professional advice

Tests, explanations, summaries, podcasts, the assistant's answers and the grades for written papers are generated automatically and may contain mistakes. Double-check anything important against official sources.

Grades, scores, bands and estimates (like "Which specialty would you have matched?") are indicative: they show where you stand, but they aren't official results and don't guarantee your exam result. If you disagree with how a paper was graded, you can ask for a second grading from the results page.

Brioly is a study tool. It doesn't replace teachers, textbooks or professional advice; medical content (including the atlas and residency prep) is educational and isn't medical advice.

10. Groups, communities, assignments and challenges

11. What you can't do

12. The iOS and Android apps

The Brioly apps on the App Store and Google Play give you access to the same service and are covered by these terms. The agreement is only between you and DATA SWEEP: Apple and Google aren't responsible for the app, its maintenance or any claims about it, but they are third-party beneficiaries of these terms and may enforce them against you. When you download the app, you also follow the rules of the store you got it from.

13. Intellectual property

Brioly, its name, logo, design, code and the content we create belong to DATA SWEEP or our licensors. We give you a limited, non-exclusive, non-transferable and revocable right to use the platform for personal use, under these terms.

14. Availability and liability

We work hard to keep Brioly running well, but the service is free and provided "as is", with no guarantee that it will always be available, error-free or fit for a particular purpose. We may carry out maintenance and temporarily turn some features off.

To the extent the law allows, we aren't liable for indirect losses (such as lost data, lost opportunities or an exam result). We don't limit liability for harm caused intentionally or through gross negligence, or the rights you have as a consumer under the law.

15. Suspending and closing accounts

We may suspend or close an account that breaks these terms or the law, or that puts the platform or other users at risk. We'll tell you why, unless the law or an authority requires otherwise, and you can appeal. You can close your account at any time.

16. Governing law and disputes

These terms are governed by Romanian law. If something's wrong, write to us first and we'll try to sort it out amicably. You can also contact Romania's National Consumer Protection Authority (ANPC, www.anpc.ro), including for alternative dispute resolution. If we can't reach a solution, disputes go to the competent courts in Romania, without affecting your right as a consumer to go to the courts where you live.

17. Changes, other terms and contact

We may update these terms. We'll tell you about important changes in the app or by email at least 15 days before they apply; if you don't agree, you can close your account. Using Brioly after that date means you accept the updated terms.

If any part of these terms is found invalid, the rest still applies. The Competition Rules, Privacy Policy and Cookie Policy apply together with these terms.
